SCULPT41° STONINGTON STUDIO & SCULPT41° MYSTIC STUDIO
1. INTERPRETATION AND VARIATION
1.1 SCULPT41° reserves the right to vary and revoke the Terms and Conditions from time to time, which variation it may consider necessary or desirable for the regulation of the affairs of the Studio and the conduct of Members.
1.2 The Terms and Conditions will be governed by the laws of Connecticut and subject to the exclusive jurisdiction of the Connecticut courts.
2. MEMBERSHIP
2.1 Subject to these terms and conditions, when a person has completed the online registration, they will become a Member of the Studio.
2.2 Acceptance of a person as a Member is in the absolute discretion of the Company.
2.3 The Company reserves the right to expel from the Studio, suspend for a specific period, or refuse to renew the membership of any Member whose conduct is or may, in the Company's reasonable opinion, be injurious to the character of the Studio or a breach of the Terms and Conditions.
2.4 If a Member brings a guest to the Studio for a session, that guest must first become a Member in accordance with the Terms and Conditions.
2.5 Members must be eighteen (18) or over.
3. STUDIO OPENING TIMES
Details of session times at the Studio may vary from time to time. Session times will be published by the Studio and available either at the Studio or at www.sculpt41.com. Class schedules and availability are subject to change at any time.
4. PAYMENT TERMS
4.1 Details of session prices and gift certificate prices are available either at www.sculpt41.com or directly from the Studio and will be such prices as determined by the Company.
4.2 A Member may not attend any session at the Studio without first booking and paying for the session.
4.3 Payments for sessions and gift certificates are non-refundable unless otherwise stated.
4.4 Pricing, packages, and membership terms are subject to change at any time.
4.5 All sales are final. No refunds, extensions, or transfers will be granted unless otherwise stated.
4.6 Credits and memberships purchased can only be used in the location purchased and are non-transferable across regions.
5. BOOKINGS AND CANCELLATIONS
5.1 Sessions are booked on a first-come, first-served basis through the SCULPT41° booking platform.
5.2 If a class is full, Members may join the waitlist. If a spot becomes available, Members may be added to class up to 1 hour prior to the scheduled start time.
5.3 Cancellations must be made at least 12 hours prior to the scheduled class time. Any cancellation within 12 hours of class is considered a late cancel.
5.4 No-shows and late cancellations will result in loss of credit or a fee ($34 no-show, $25 late cancel).
5.5 The Studio reserves the right to limit active reservations, cancel bookings, or adjust scheduling privileges in cases of excessive booking, repeated late cancellations, or behavior that restricts fair access for other Members.
5.6 Failure to arrive on time may result in forfeiture of the reserved spot, applicable fees, and the Studio reserves the right to release the spot to another Member.
6. FITNESS AND HEALTH
6.1 Members confirm they are fit and healthy to participate in physical activity and do not suffer from medical conditions that may endanger them or others.
6.2 Members must notify the Studio of any health changes prior to each class.
6.3 The Studio advises members to consult with a doctor if unsure of their fitness to participate.
6.4 The Studio reserves the right to deny participation if it believes a Member’s health is at risk.
6.5 Members must follow instructor directions at all times.
6.6 Members who are pregnant, recovering from injury, or managing medical conditions participate at their own risk and are responsible for informing instructors of any limitations prior to class.
7. LIMITATION OF LIABILITY
7.1 SCULPT41° is not responsible for changes to instructors, equipment, or class formats.
7.2 Members are responsible for their own health and physical condition; participation is at their own risk.
7.3 The Studio accepts no liability for lost property or injury except where prohibited by law.
7.4 By participating, Members waive and release SCULPT41° from liability for injuries, damages, or death (including pregnancy-related injury or fetal loss) resulting from participation in any activity or use of Studio facilities. This includes any injuries resulting from equipment use, instruction, or participation in any SCULPT41° class or activity.
8. USE OF FACILITIES
8.1 Use of the Studio’s facilities is subject to change or interruption without notice for cleaning, maintenance, or other reasons.
9. PERSONAL BELONGINGS
The Studio is not liable for any lost, stolen, or damaged belongings.
10. DRESS
Members must wear appropriate workout attire, including non-slip socks. Shoes must be removed in entry areas.
11. SAFETY & HYGIENE
11.1 No food, glass, or crockery is allowed in studio spaces. Water is permitted.
11.2 Members with foot infections must not go barefoot.
11.3 Fire exits must not be blocked. In the event of fire, members must exit the premises promptly.
11.4 Smoking is prohibited on the premises.
12. GENERAL
12.1 Members must update the Studio with any change of address.
12.2 The Company may refuse Studio entry at its discretion.
12.3 Memberships, class packages, and registrations are non-transferable and may not be shared.
12.4 These Terms do not create third-party beneficiary rights.
12.5 Members agree to receive emails and acknowledge email may not be secure.
12.6 Members must follow Studio guidelines and staff instructions.
12.7 All marketing, educational, and studio materials remain the property of the Company.
12.8 By opting in to any forms, members agree to receive text messages from SCULPT41° about services and promotions. Message/data rates may apply. Text STOP to opt out.
13. WAIVER OF JURY TRIAL
13.1 The parties knowingly waive the right to a jury trial for disputes arising out of this agreement.
14. MEDIATION AND ARBITRATION
14.1 Disputes shall first be resolved by good-faith mediation administered by the AAA in Connecticut. If unresolved, disputes will be settled by binding arbitration under AAA rules.
14.2 Arbitration to be completed within 45 days of demand; no post-hearing briefs.
14.3 The arbitrator’s decision is final and may be entered in any Connecticut court.
14.4 Arbitrator’s fees are split equally; prevailing party may recover attorney’s fees.
14.5 Either party may seek temporary injunctive relief in court as needed.
15. PHOTO & VIDEO CONSENT
By entering the Studio or participating in any class or event, Members acknowledge and agree:
SCULPT41° may record photo or video content during classes or events.
Such content may be used for marketing, promotional, or training purposes on social media, websites, or printed material.
By attending, Members consent to their image, voice, and likeness being used without compensation.
If a Member wishes to opt out, they must notify the Studio in writing. While the Studio will make reasonable efforts to accommodate such requests, incidental appearances may still occur.
16. STUDIO ETIQUETTE & CONDUCT
16.1 To maintain the quality and experience of SCULPT41°, Members are expected to arrive on time, follow instructor guidance, and be respectful of the Studio space, equipment, and fellow Members.
16.2 While photos and videos are permitted, Members are expected to be mindful of others and respectful of personal space. Filming should not disrupt the class experience or include other Members without their consent.
16.3 Phones are not permitted on the machines. Phone use during class is not permitted except in the case of an emergency.
16.4 Water bottles, personal items, and belongings are not permitted on the machines.
16.5 Shoes are not permitted on the machines under any circumstances.

Text Messaging
By providing your phone number, you consent to receive text messages from SCULPT41° related to your bookings, account, and studio updates. Message and data rates may apply. You may opt out at any time by replying STOP.

SCULPT41° does not sell or share your personal information with third parties.
We may share information with trusted service providers (such as payment processors and booking platforms) only as necessary to operate our business.
